The trial of Brian Lamb began Monday morning in Penticton Provincial Court with testimony from the 10-year-old boy who was assaulted in Kaleden Park last August.

Fifty-year-old Lamb, who attended his trial in person, told the court that he pleaded not guilty in connection with attacks on a four- and ten-year-old boy in Kaleden Park on August 25, 2020.

Accompanied by a Penticton victim service and their companion dog Calypso at the boy’s side, the boy and his mother testified that he had gone to the park and beach at Kaleden that afternoon with his friend and his friend’s four-year-old brother and his parents.

As a resident of Kaleden, the boy spent many summer days on the beach and parked there.

Other friends were in the park that day. They all gathered to chat on the basketball court when the 10-year-old boy said a man appeared right next to him.

“The man said something about a man in a wheelchair. He was talking loudly. I stood there. I was scared, ”said the boy. The boy told the court that he hadn’t said anything to the man.

“He grabbed my neck tightly and hit my cheek once with his other hand. He hit me hard. I ran away to my parents. “

Defense asked the boy if he had seen the man first approach the four-year-old. He said he did.

“The man said he wouldn’t hurt [the four-year-old]. Do you remember that? “The boy replied,” Yes. “

Testimony from an eyewitness, Cory, who was on vacation and saw the altercation, revealed that a man who was alleged to be a lamb first approached the four-year-old boy on the basketball court, grabbed him, and then grabbed the 10 -year-old. He seemed “excited” before approaching the children, she testified.

She testified that she could see Lamb’s back and the 10-year-old boy’s front. She said the man’s hand raised the boy two or three times.

Photos of the 10-year-old and 4-year-old were taken by local police on the day of the attack. These photos were submitted in the process. The 10-year-old went through the pictures of bruises and scratches on his neck and face.

While cross-examining the boy, Lamb’s defense attorney asked the boy if he was wrong about a man who slapped him in the face. The boy replied, “No.”

Several parents witnessed the altercation and persecuted Lamb, along with an off duty officer who held Lamb until RCMP came to arrest him. Lamm has been in prison ever since.

The off duty officer will testify along with the boys’ parents and some of the children who were on the basketball court at the time.

The process continues.
