A 43-year-old Kelowna woman has been sentenced to house arrest for molesting her eight-year-old daughter.
The woman, referred to only as PRJ in court documents, was sentenced to 12 months of house arrest at the Kelowna Courthouse on December 13, followed by an additional 11 months under curfew.
According to a Supreme Court decision dated August 31 B.C. Judge Barry Davies found PRJ guilty of sexually assaulting her daughter in November 2018.
The decision says the daughter, identified only as P in the documents, told her aunt what happened after her mother was admitted to a drug rehabilitation center.
In a case largely based on the testimony of the now 10-year-old daughter, Judge Davies said the young girl was “steadfast” and an “honest witness”.
However, Justice described the mother’s testimony as “evasive, argumentative and defensive” and was “deliberately designed to now veil with an air of innocence the genesis of her sexual touching that night”.
In November 2018, the then eight-year-old daughter climbed into bed with her mother, as so often, according to the decision.
However, that night, the mother sexually touched and kissed her daughter.
Weeks after the abuse, the daughter called her grandmother one morning because she couldn’t wake her mother.
The mother then entered a drug rehabilitation program and the daughter lived with her aunt.
The court documents show that the police explained to the almost 11-year-old daughter in long and detailed interrogations what her mother had done to her.
In the interview, the daughter says she is “angry and sad” about what her mother did.
In court, the mother admitted that the daughter had slept with her and that they were both naked, but denied there was any sexual touching.
Court documents say the mother had a history of substance abuse, but she downplayed it in court.
In addition to being sentenced to house arrest, the woman was also given advice and a ten-year gun ban.
